Yvonne Gonzalez Rogers, the presiding judge of the Apple vs. Epic Games case, said that when the two companies first went to court, she “tends” not to ask Apple to relist “Fortress Night” .
But she seemed to agree with Epic Games’ statement at Monday’s hearing that Apple’s threat to no longer be compatible with the “Unreal Engine” graphics technology was an act of revenge. Unreal Engine is a set of software used by developers to develop 3D games and other products.
Apple faces criticism from some developers who believe that the App Store’s 30% fee collection and other policies are unfair and beneficial to the company’s own services.
The lawsuit between Apple and Epic Games was caused by the latter informing customers on August 13 that it would discount the “Fortress Night” game items purchased directly from the company. Apple subsequently removed the game, resulting in more than 1 billion iPhone and iPad users unable to use the game.
Rogers doesn’t seem to think that Epic has suffered an “irrecoverable loss.” But she also said that Apple’s decision to block Unreal Engine “is indeed like revenge.”
Epic stated in a file submitted last Sunday that prohibiting Epic from using Apple’s iOS and Mac developer tools will prevent the game company from continuing to distribute Unreal Engine to other developers. As the manufacturer of Xbox, Microsoft also uses this technology to develop consoles, PCs and mobile games. The company supported Epic’s views in court.
Apple has said that Epic CEO Tim Sweeney hopes to reach a “side” deal to provide special treatment for “Fortress Night”. But Apple executives believe that this move will completely subvert the App Store’s operating model.
Sweeney insisted that he didn’t want special treatment, but he hoped that Apple would provide the same options to all other developers.
There are 2.2 million apps in the App Store, and a 30% rate applies to more than 350,000 apps. After users have subscribed for more than 1 year, Apple will reduce the ratio to 15%.
